What Are the Symptoms of Cerebral Palsy?


Cerebral palsy falls into three different categories namely spastic cerebral palsy, Athetotic palsy and Ataxic cerebral palsy. Cerebral palsy is a disorder that occurs when the part of the cells that makes up the part of the brain in control of muscular movements are damaged or destroyed.

The signs and symptoms of more than a single type of cerebral palsy can be seen in a mixed condition in some children. However, generally the signs and symptoms exhibited by children with cerebral palsy could be from mild to even severe. The symptoms of cerebral palsy however do not get worse as the child grows.

The signs and symptoms of cerebral palsy in children include stiffness in muscles and spasticity when the muscles become completely frozen, a walking gait that is asymmetrical with either one foot or leg, which they tend to drag. They have lack of muscle co ordination when they perform actions. Their muscles could be either too stiff or floppy and they will show signs of excessive drooling because they are unable to swallow anything even the saliva. Have an artificial heart valve
Suffer uncontrolled hypertension
Are diabetic
Are known to have raised cholesterol
Have a family history of strokes

Any one or combination of the above can provide predisposing factors for having a stroke. Diagnosis is usually based on symptoms and results of physical examination, imaging tests and blood tests (Merck Manuals, 2007). There is no blood test or electrocardiogram (ECG) specific for stroke, and CT scans may be entirely normal for up to six hours after acute onset of stroke. Thus the neurologist becomes an irreplaceable member of the team to acutely evaluate stroke patients (Llinas, 2006). A condition called "atherosclerosis" is commonly the cause of the blockage of the blood vessel, and atherosclerosis pertains to fatty deposits that accumulate on the walls of the vessels causing a disruption or total blockage to the much needed blood supply to the brain. These fatty deposits can cause two types of obstruction:

Cerebral thrombosis - this refers to a thrombus (blood clot) that develops at the clogged part of the vessel.

Cerebral embolism - this refers generally to a blood clot that forms at another location in the circulatory system, usually the heart and large arteries of the upper chest and neck. A portion of the blood clot breaks loose, enters the bloodstream and travels through the brains blood vessels until it reaches vessels too small to let it pass. A second important cause of embolism is an irregular heartbeat, known as atrial fibrillation. It creates conditions where clots can form in the heart, dislodge and travel to the brain. (American Stroke Association, 2008) Rapid intervention is required to provide optimal treatment for the patient who has suffered an acute ischemic stroke. Early assessment and rapid intervention are crucial to avoid the risk of permanent disability or at worse death. The use of rapid assessment and early intervention is essential in all presenting cases. Thrombolysis with tissue plasminogen activator has been labeled for the treatment of acute ischemic stroke, but it must be given within three hours of stroke onset. However, fibrinolytic therapy can be given safely to only a fraction of patients with acute stroke, and more broadly applicable therapies are needed. Recent evidence does not support the routine use of heparin in patients with acute stroke, and early use of aspirin offers only modest benefit (Benavente and Hart, 1999). The use of Aspirin to treat those who have had an ischemic stroke is not uncommon, Aspirin works in such a way as to thin the blood to sufficient levels to avoid the formation of blood clots that can cause such events.

Intra-cerebral Hemorrhage (ICH) An intra-cerebral hemorrhage is one of two types of hemorrhagic stroke and is a type of stroke caused by the sudden rupture of an artery within the brain. Blood is then released into the brain, compressing brain structures (Stroke Center, date unknown). The most common cause of intra-cerebral hemorrhage is hypertension. Difficulties arise when individuals experience high blood pressure without knowledge of the fact, as more often than not hypertension does not display any adverse symptoms. There are some less common causes of intra-cerebral hemorrhage and these include:


Trauma (particularly head injury)
Infection (systemic)
Abnormalities with individual blood vessels
Blood clotting disorders

Oral anticoagulation is another factor that contributes to the increasing incidence of intra-cerebral hemorrhage. As the population continues to age, the number of indications for long-term anticoagulation continue to increase (Ansell et al, 2001). Because of the high mortality rate of patients who have suffered intra-cerebral hemorrhage often is the case that anticoagulation therapy is avoided due to possible undesirable effects such as ICH. Intra-cerebral hemorrhages tend to begin abruptly and the patient will usually experience a severe headache. Other presenting symptoms may also be:


Weakness, paralysis or loss of sensation usually affecting one side of the body only.
Slurred speech
Confusion or altered level of comprehension
Loss of consciousness

Brain CT or MRI scan is the popular diagnostic tool in the case of ICH. Results are quick and conclusive therefore allowing management of the problem to begin without delay. At this current time there is no FDA approved treatment for intra-cerebral hemorrhage, unlike other types of stroke. Treatment depends on the location, cause, and extent of the hemorrhage. Surgery may be needed, especially if there is bleeding in the cerebellum. Surgery may also be performed to repair or remove structures causing the bleed such as a cerebral aneurysm or arteriovenous malformation (Dr Koop, 2006). The prognosis for intra-cerebral hemorrhage is more likely to be fatal than that of ischemic stroke. Bleeding is usually more severe and damage to the brain profound. Where death does not occur, there is nearly always depleted brain function.

Subarachnoid Hemorrhage (SAH) A subarachnoid hemorrhage is also a type of stroke caused by the sudden rupture of an artery. This type of stroke is the second type of "hemorrhagic stroke". A subarachnoid hemorrhage differs slightly from an intracerebral hemorrhage in that the location of the rupture leads to blood filling the space surrounding the brain rather than inside of it (Stroke Center, date unknown). The most common cause of subarachnoid hemorrhage is abnormalities in the blood arteries at the base of the brain. These are called "aneurysms". The arteries swell and become weak they can then rupture causing the hemorrhage to occur. Known risk factors for subarachnoid hemorrhage include:


Smoking
Putative factors such as: increasing age, female gender, black race, alcohol abuse, binge drinking.
Increased risk with high body mass index has been suggested.

And causative factors include:


Trauma
Vascular malformations of the brain or spinal cord
Blood dyscrasias
Less commonly reported: tumors, infection and vasculopathies.

When an intracranial aneurysm ruptures into the subarachnoid compartment, it causes a subarachnoid hemorrhage (SAH). An estimated 10% of SAH cases result in sudden death due to the rapid and marked increases in intracranial pressure caused by the ruptured aneurysm (Mayo Foundation for Medical Education and Research, 2006). Rapid diagnosis is essential in all cases of SAH, as treatment is possible even if the outcome is not always a positive one. Head CT scan is the commonest diagnostic imaging used in suspected cases of SAH. Not only is the test one which is easy to arrange and quick to perform it also gives clear and concise data on the extent of damage, if any to the brain. In cases where CT brain appears normal a lumbar puncture would be the next test as in some cases blood can be detected in the spinal fluid obtained during the test.

There are varying types of symptoms of a subarachnoid hemorrhage however acute onset of severe headache is the most common. This is often associated with vomiting, and in serious cases coma occurs soon after the cerebral aneurism has ruptured. Surgery is one option in the treatment of SAH, if the hemorrhage is due to an injury or ruptured aneurysm. If no blood clot or aneurysm is identified then medical management is the way forward. For some with extensive damage death is likely and despite treatment cannot be avoided. Where medical management is possible, treatment may be as follows:


Use of intravenous anti-hypertensives is preferable, as high blood pressure will undoubtedly exacerbate the problems and risks.
Analgesia and anti-anxiety medications are also helpful to minimize pain and distress caused by the event.
In many cases anti-seizure treatment such as 'Phenytoin' is given as patients can be at risk of seizures due to increased pressure in the brain.
Bed rest to avoid exertion and subsequent pressure to the brain will be recommended.
Avoidance of straining is also essential, and in most cases patients are given stool softeners and/or laxatives to assist bowel movements and avoid straining.

With treatment is 'stroke' prevention and therapy advancing all the time the outlook for those who suffer ischemic or subarachnoid episodes continues to improve. The key to all success where stroke is concerned is early diagnosis and subsequent treatment.

Cerebral Palsy is an abnormality in moving and controlling movements; it is acquired at an early age and is caused by brain damage that makes it non-progressive. It is thought that about one in 500 children in the UK has some form of cerebral palsy.

The causes of cerebral palsy are many. It usually results from some damage to certain parts of the developing brain in infants. This damage to the brain generally occurs early in the pregnancy, when the brain is starting to form. However, it can also occur after birth or in the first few years of the life of a child. What Causes Cerebral Palsy?


It is not surprising to many people when they hear that thousands of babies born all over the globe are affected by cerebral palsy. Cerebral palsy is certainly not a contagious disease as some people think it to be. Moreover, it is certainly not a byproduct of this new world filled with technological advancements. It has been around for centuries, and only in 1861, did physicians begin their study of this disorder.

A child struck by this disorder in their early years of life can be distinguished from other normal children of the same age by the stiff muscles in both their arms and legs, which prevent them from crawling, walking and even from trying to grasp their toys or any other objects. Cerebral palsy means disorder of the part of the brain which causes muscles to become weak. There is no muscle coordination at all and this prevents them from changing their body positions with ease.

Cerebral Palsy is the most common childhood physical disability. Around one in every 400 children born in developed countries has CP. In the United States, it is estimated that some 764,000 children and adults exhibit one or more of the symptoms of Cerebral Palsy. Around 8,000 babies and infants are newly diagnosed with the condition each year. Despite medical advances, incidence has not declined over the last 60 years.

Often the exact cause of a child developing Cerebral Palsy is not known, but contributing factors can include infections such as meningitis, bleeding into the brain, pressure or blows to the head and lack of oxygen. These may have occurred before, during or after birth and the severity of the cause will affect the severity of the damage caused to the brain. For example, each minute that a baby is deprived of oxygen during a difficult delivery will increase the extent of brain damage caused.

Cerebral Palsy is classified into three main types; Spastic, Athetoid and Ataxic. Those with Spastic CP have muscles that are weak, tight or stiff making it difficult for the person to make controlled movements. Those with stiff or tight muscles will find it difficult to fully extend arms and legs, while those with weak muscles may be unable to stand unaided. Spastic Cerebral Palsy is the most common type of cerebral palsy, accounting for nearly 80 percent of all cerebral palsy cases.

Athetoid Cerebral Palsy is caused by damage to the cerebellum or basal ganglia. These two areas of the brain work in opposition to create smooth, coordinated movements as well as maintaining body posture. Damage to one or both of these areas creates an imbalance that may cause a child to develop involuntary, uncoordinated movements, especially in the face, arms, and trunk. Secondary problems with eating, speaking, picking up objects may also result from the imbalance. Approximately 10% of those with Cerebral Palsy are Athetoid.

Ataxic Cerebral Palsy is characterised by low muscle tone and poor coordination of movements. Ataxic children look very unsteady and shaky and have a disturbed sense of balance and depth perception. This is particularly apparent when walking which is unsteady and can resemble an intoxicated adult. Ataxic children can also suffer from shaky hands which make it difficult to hold a pencil and write.

Although Cerebral Palsy is not progressive (the brain damage does not get worse) and there is no cure (brain damage can not be repaired), tight, stiff or weak muscles will become increasingly so as the child gets older without therapy or treatment and in severe cases surgery. As a result, the child will inevitably become more dependant on their parent or carer and less able to lead any sort of independent life. Appropriate and regular therapy provided from an early age can significantly improve mobility and coordination abilities, independence and quality of life.

Cerebral palsy or cp, is not a single condition but rather a group of disorders which cause motor disability affecting body movements and muscle coordination caused by damage to one or more specific areas of the brain

Many variables contribute to the cause of cerebral palsy, the most commonly of which is brain injury before or during birth. It can also happen after birth due to brain damage in the very early years, perhaps from bacterial meningitis or a head injury.

Children with cerebral palsy may not be able to walk, talk, eat or play in the same ways as most other children and will, unfortunately, have it all their lives.

Although children with very mild cerebral palsy occasionally recover by the time they are school-aged, it is usually a lifelong disability.

In most cases, the movement and other problems associated with cerebral palsy affect what a child is able to learn and do to varying degrees throughout their life.

However, It is important to realize that cerebral palsy is not a disease or illness. It isn't contagious and it doesn't get worse.

Depending on which areas of the brain have been affected, one or more of the following may occur: muscle tightness or spasm; involuntary movement; disturbance in gait and mobility; abnormal sensation and perception; impairment of sight, hearing or speech and seizures.

In the United States today, more people have cerebral palsy than any other developmental disability. About two children out of every thousand born have some type of cerebral palsy. Studies have shown that at least 5000 infants and toddlers and 1,200 - 1,500 preschoolers are diagnosed with cerebral palsy each year. In all, approximately 500,000 people in the US have some degree of cerebral palsy.

The term cerebral palsy itself encompasses many different disorders of movement and posture. To describe these, pediatricians, neurologists, and therapists use several classification systems and many different labels.

Doctors frequently delay in making a diagnosis of cerebral palsy in young children. This is due to the plasticity of a child's central nervous system. The brains of very young children have a much greater capacity to repair themselves than do adult brains.

Also a child's nervous system organizes over time, therefore health care professionals need to assess the child's strengths and needs in all areas.

Generally, however, a child's motor symptoms stabilize by two to three years of age. After this age, tone is probably not going to change dramatically.

Cerebral Palsy Treatment


Families that have children with cerebral palsy know that there is no cure for it.  The only thing that families can do is get the best treatment for their child.  What type of treatments considered for a child depends on what type of cerebral palsy they have.  The medical staff will determine what type they have by the characteristics the patient has.Determining which type of treatments is given to a patient is done through observing the patient and giving them some tests.  In this process a team of professionals such as therapists, psychologists and pediatricians will determine, based on the results of the patient, which treatments suit them. 

Types of treatments:

Physical therapy - This method of therapy helps stretch the muscles of a patient with cerebral palsy.  This can include exercising the muscles, massaging the muscles and possibly using heat.  The purpose of this is to help with motor control. 

Speech therapy - It is sometimes difficult for patients with cerebral palsy to communicate.  With speech therapy, the treatments allow them to communicate with other means. 

Occupational therapy - This treatment is to assist patients with this in their everyday living.  This includes household duties and work duties. 

Medication - There are medications for cerebral palsy patients that will help relax their muscles.  Patients deal with muscle spasms and medications such as Botox will help those problems.

Cerebral Palsy Claims


Cerebral palsy claims are successful if it can be proven that a child's cerebral palsy, which can be of many different types and have many different causes, was actually caused by hypoxia or oxygen deprivation when it was a foetus, and this arose from a hospital doctor's or nurse's negligence, for example in not carrying out a caesarean section earlier despite signs of foetal distress, such as bradycardia or low foetal heart rate as measured on a cardiotocograph (CTG).

Children injured through medical negligence are currently entitled to Legal Aid funding for their cerebral palsy claims as their claims will deemed meritorious and the child will usually be financially eligible, based on an assessment of their own resources rather than their parent's resources.

The starting point of any claim, and of any application for public funding, is a statement from the child's mother dealing with her full obstetric and gynaecological history, and in particular with the events surrounding this particular child's birth.

Once legal aid is obtained a medical report is obtained from an obstetrician on whether negligent mistakes were made. If the mother's care was midwife led it will often then be necessary to obtain a report from a midwife.

The legal test for clinical negligence is such that if the defendant hospital's obstetrician or midwife can produce another leading obstetrician or midwife to support the treatment that was given, or can refer to a leading textbook, the hospital may be able to successfully defend the claim.Furthermore, to win, the claimant must also prove causation of cerebral palsy by asphyxia on a balance of probabilities, which is frequently difficult.

On receipt of each expert's report it is likely that conferences with the expert/s, the client and a barrister will be arranged by the solicitors to understand and test the expert evidence.

If the report from the obstetrician and /or the midwife is positive on breach of duty, a report from a paediatric neurologist is obtained on whether that mistake caused the cerebral palsy, rather than some other cause.

Additionally if this report is positive, then a report from a neuroradiologist on a child's MRI brain scan can help to establish causation.

Deprivation of oxygen to the brain (asphyxia) or head trauma sustained during labor and/or delivery can cause cerebral palsy. Severe asphyxia for a lengthy period can produce brain damage called hypoxic-ischemic encephalopathy, which causes many infant deaths.

Asphyxia refers in general terms to the end result of reduced oxygen and nutrient supply to the fetal brain. During labour it is assessed by fetal heart rate monitoring on a cardiotocograph (CTG), the results of fetal scalp blood sampling, and the passage of meconium.

After a child's birth, hypoxic-ischaemic encephalopathy is a sign that the infant has suffered enough asphyxia to cause some brain injury. Its severity is a far more reliable predictor than a low Apgar score or acidosis.

The infant who develops hypoxic-ischaemic encephalopathy may require resuscitation at birth. After an interval that may vary from minutes to many hours the infant shows changes in tone, activity, and patterns of primitive reflexes. This may be hyperalertness or declining consciousness. Fits and abnormal movements develop, and there are abnormalities of sucking, feeding, and eye movements. The infant may deteriorate and die, recover completely, or progress slowly and continue to show abnormal neurological signs.

However, it must be stressed that the vast majority of congenital cerebral palsy is not caused by birth asphyxia. Often unknown events during pregnancy, labour, and delivery damage motor centers in the developing brain and cause cerebral palsy. Infections during pregnancy, such as German measles (rubella), cytomegalovirus and toxoplasmosis, can damage the fetus's developing nervous system.

Brain hemorrhage, or bleeding, can occur in the fetus during pregnancy or in newborns around the time of birth, damaging fetal brain tissue and causing neurological problems, including congenital CP. These hemorrhages are a type of stroke that may be caused by broken, abnormal, or clogged blood vessels in or leading to the brain, or by respiratory distress, a common breathing disorder in premature infants.

Assuming, however, that positive reports on breach of duty and causation are obtained and it can be proven that a child's cerebral palsy was actually caused by hypoxia, the next stage in the claim is for a formal detailed letter of claim, usually drafted by counsel, to be sent out to the hospital trust or their solicitors. Realistically it will take them at least six months to reply to this letter substantively in a formal response letter,as they will have to commission their own expert evidence, and on receipt consider and test it.

Normally liability will be disputed and court proceedings will have to be commenced. In order to save costs it is likely that the court will then order a split trial, with quantum only being dealt with if the claimant wins a trial on liability. Before trial various stages are passed through to try to reduce the issues between the opposing medical experts but ultimately it may be necessary for them to give oral evidence at a trial and for a judge to apply the aforementioned tests of medical negligence and causation, and decide whether or not the claimant has proved his or her case.

If so, then the quantum of their successful cerebral palsy claim can run into many millions. During the course of the subsequent proceedings reports are obtained from many quantum experts including speech, physio and occupational therapists, nursing and housing experts. Increasingly such experts are instructed jointly by both parties to save costs.

Based on such quantum reports the Claimant will produce and serve a Schedule of Loss and the Defendant a Counter schedule. If a reasonable quantum settlement cannot be reached and approved by the court, which is in order to protect the claimant, a trial on quantum will have to take place. Once damages are awarded they will be administered by the Court of Protection on the Claimant's behalf.
